Privacy Statement

General
Fraser Downs* respects the privacy of your personal information. This Privacy Statement provides information about what personal information Fraser Downs collects and how we use that information. This Privacy Statement also provides direction on what to do if you do not want your personal information collected or shared and how to contact our company with respect to personal information.

What information will Fraser Downs collect?
Fraser Downs collects personal information from you (such as your name, address, telephone number or email address) when you provide it to us voluntarily; for example when you make an application for a wagering account, whether in person or through our Internet “Horseplayer Interactive” website, or enter one of our promotional contests.

When you contact us through our Internet website, we may collect information on-line about you that is not personal information. Examples of this type of information include the type of Internet Browser you are using, the type of computer operating system you are using and the domain name of the website from which you linked to the Fraser Downs website, advertisement or promotion.

How will Fraser Downs use and disclose the personal information we collect?
We recognize that by providing us with personal information, you are demonstrating your trust in our company and we take that trust seriously. We collect and use this personal information to respond to your inquiries, to administer a promotion in which you have voluntarily participated, to manage our business and to better understand your needs and how we can improve our products and services. We reserve the right at all times to collect, use and disclose any information where required or permitted by law or regulatory authority to do so or to protect the legitimate interests of Fraser Downs.

Where applicable, Fraser Downs also transfers your personal information to our service providers hired to administer or provide products, services or information on our behalf. We require the organizations with whom we share your personal information for these purposes to use your personal information only to perform the services we have hired them to provide.

How will Fraser Downs protect my personal information it collects?
Fraser Downs has physical, electronic and managerial procedures designed to protect the integrity, security and appropriate use of personal information. Given that unencrypted electronically transmitted data is not 100% secure, we make no warranties as to the security of any information that you submit electronically, which is done at your own risk.

Your Consent
If you choose to provide personal information to Fraser Downs, we assume that you consent to the collection, use and disclosure of your personal information as described at the time of collection and as outlined in this Privacy Statement. Your consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question. If you do not consent, please do not provide your personal information or, where applicable, exercise the opt-in or opt-out options offered. Subject to legal and contractual requirements and reasonable notice, you may refuse to consent to our collection, use and disclosure of your personal information or you may withdraw your consent by contacting our Privacy Manager, Jeff Tait, at the address listed below. We will explain the consequences of the withdrawal of your consent.

Use Without Consent
There are instances where Fraser Downs may collect, use or disclose your personal information without your consent; for example to collect a debt you owe to us, to comply with a subpoena or court order, or to comply with the rules of court regarding the production of records.

Access, Correction, Inquiries and Complaints
We maintain a file of your personal information for the above-mentioned purposes. This file is accessible during regular business hours at Fraser Downs’ offices, 17755 60th Avenue, Surrey, B.C. Authorized Fraser Downs’ employees have access to your personal information.

If you wish to request access to, or correction of, your personal information in Fraser Downs’ custody or control, or find out how we’ve used or disclosed that information, please make your request in writing to Jeff Tait, Privacy Manager at the address listed below. We may need to verify your identity before searching for or providing you with personal information. In some circumstances, we may not be able to provide access to your personal information, for example if it contains the personal information of other persons, if it constitutes confidential commercial information, or if it is protected by solicitor-client privilege. If we deny your request for access to, or refuse a request to correct, your personal information, we will advise you of the reasons for this refusal.
